J’ai découvert le “Fiduciary Licence Agreement” de la Free Software Foundation durant l’atelier de Michel Jaccard à Lift07, grâce à la présentation de Shane Martin Coughlan.

Dans leurs propres mots:

The Fiduciary Licence Agreement (FLA) is a copyright assignment that allows Free Software projects to bundle their copyright in a single organisation or person. This enables projects to ensure their legal maintainability, including important issues such as preserving the ability to relicense and certainty to have sufficient rights to enforce licences in court.

J’imagine évidemment une application à d’autres oeuvres “collectives” où la vie du résultats doit dépasser celle des auteurs eux-mêmes.

Sur le site d’une conférence où je n’irai pas, quelques ressources intéressantes sur les standards ouverts (lien direct vers le cadre).

Notamment un article de Pam Samuelson sur le droit d’auteur dans les standards ouverts que je trouve particulièrement savoureux (ça fait changement des questions de brevets), un pavé sur les organisations de standardisation et les brevets et un papier de Carl Cargill de Sun qui pose un constat lucide sur l’état de l’utilisation des standards comme outils de gouvernance, sujet qui m’est très cher.

Les Recommendations du secteur des télécommunications de l’UIT sont disponible gratuitement pour téléchargement depuis le 1^er janvier.

Elles resteront disponible gratuitement au moins jusqu’au prochain meeting du Conseil en septembre 2007, en vertu de la Décision 542 du Conseil, faisant suite à un processus ayant commencé en 2004 à l’AMNT, poursuivi par l’Australie au Conseil 2005, appuyé par le CGNT cette même année, étoffé par le secrétariat en 2006 et puis approuvé par le Conseil cette même année (et patati et patata)…

In the other direction, standards bodies need to recognize that open source development is fundamentally different than traditional software development.

When working with the open source community, participation and buy-in are critical—you can’t just declare something to be so and expect the open source community to just follow suit—as is the ability to move quickly. For the FSG’s part, we understand all of this very well—after all, we grew out of the open source community—but it’s an observation other standards efforts would do well to keep in mind as open source and open standards increasingly intersect.

Parlant d’ouvert et/ou libre, Joi Ito cite Irving Wladawsky-Berger’s definition of Open Standards:

If a crunch comes between the interests of the shareholders and interests of the community, a business has to choose the interests of the shareholders. A business creating a standard that it controls and says is ‘open’ and that people should ‘trust them’ is not robust from that perspective. Business should prevent itself from getting into these situation. Working with neutral professional organizations makes it impossible for such conflicts to corrupt the process and is key to good open standards.

Je trouve qu’il y va un peu vite sur le “impossible”, mais c’est le point qui me fait hocher la tête, c’est que le mot “open” est un buzzword (mot à la mode, dans le vent, ou encore jargonnerie, selon Termium), et qu’il est utilisé à toutes les sauces pour se réclamer de n’importe quoi.

Microsoft va apparemment “ouvrir” le format de fichiers d’Office: Microsoft to give Office access to rivals. Le tout sous l’égide de ECMA (pourquoi?), qui a une politique unique sur les brevets: RAND.

J’hesite entre considérer ça comme une tentative de sauver les meubles pour les contrat dans les administrations publiques ou voir ça comme une une decision qui va avoir des conséquences plus vastes.
